
What is A Custody Evaluator?
A custody evaluator is a “qualified” individual with sufficient expertise in child development, child psychology or other related field; appointed by the court to basically act as its eyes and ears, evaluate the parties using the criteria found in Rule 4-903 of the Utah Rules of Judicial Administration and report to the court what is believed to be in the child’s “best interest.” These criteria include:
- Preference of the child (maturity standard); and
- Keeping siblings together; and
- Relative strength of the child’s bond with the prospective custodial parent; and
- Interest in continuing previously determined custody arrangement where the child is happy and well adjusted; and
- Primary caregiver; and
- Parent most likely to allow the child frequent and continuing contact with the non-custodial parent; and
- Moral character and emotional stability; and
- Duration and depth of desire for custody; and
- Ability to provide personal rather than surrogate care; and
- Impairment of either party to function as a parent; and
- Reasons for relinquishing custody in the past; and
- Religious compatibility with the child; and
- Kinship (biological relationship to the child); and
- Financial condition.

What Is A Parent-time Coordinator?
This would allow clients to meet with an attorney to establish their parent-time calendar for the upcoming year, and would allow them to address other issues such as special occasions, pick-up and drop-off, school functions, etc. These agreements would be codified in writing and signed by all parties and filed with the court. A written calendar would be given to both parties outlining their parent time. In addition the parent-time coordinator would be there to assist the parties when and if problems arose; If the parties were unable to reach an agreement, then the parent time coordinator would provide a written recommendation to the court or the special master whichever avenue was selected by the parties. The cost of this service is the Attorney’s hourly rate.
